Cons:

  • Class representatives may not always completely represent the interests of all class members. Conflicts of interest could arise between the representatives and certain class members, especially if the damages suffered by some class members are significantly worse or different from others. In some cases, there might be pressure to settle even if the proposal is not in the best interest of all class members involved. 
  • Similarly, class actions may include individuals who do not have a genuine interest in the case or who may not have suffered significant harm. This can lead to a larger class that silences the claims of those with more substantial injuries.
